Silence is not consent. The check has to be genuinely confidential, so the person who needs to say no can do it without exposing themselves.

Examples

Compliant An anonymous survey runs before dogs are allowed, and the result is acted on.
Not compliant A show of hands in a team meeting, or no check at all.
